This would be an excellent idea for exploring greater rewards with higher risk. However there should be areas of the open seas that have somewhat of a level of law. Think of it like EVE Online in a way. Some areas are a little safer than others. Other areas are just downright nasty.
1st question i would have is has this universe invented black powder if so then naval combat is a matter of cannons, broadsides, ramming, boarding and the potential for large multi deck gallions and manowar, if not then naval combat is a matter of arrows particularity ones which are on fire, ramming, boarding of smaller vessels and thats not even taking into account what effect magic would have had on ships of the age of sail.
One massive potential i can see for naval combat is that it would be a excellent way for the various servers to intereact with one another be it fighting for separate lands or raiding the lands of the other servers show up with a fleet and lay seige to another servers coastal city or go raiding inland this could allow for a game that expands beyond the server you are in as you can travel to new lands thus making the game one big world instead of several smaller ones.

For one it usually turns out that people will just avoid this area altogether and creates this weird "i'm in the safe zone, now i'm not" type of thing. Second, It just doesn't make sense to me why if you are over there in the murder zone, the fact you murder and steal has no bearing on your reputation. It is very "The Purge" esque.
I'm a big fan of the UO model, you could kill/steal from anyone at anytime , of course depending on where you did it had consequences. If you did it in town anywhere near a guard you would die. If you were not close to a guard you lost reputation. Of course you could do it away from town, but you would lose reputation as well.
Killing Random's not involved in an enemy guild or conflict should have some sort of penalty or ramification no matter where you are, but I don't think you should be restricted from doing it.
Big naval battle with a "commander" Element would be neat. The ability to surrender, board and fight or summon a Kracken from the deep to aid in your escape.
Floating cities owned by the best pirates in the game. Ability to have a pirate guild that owns this island and players can barter for stolen goods with the governor of the floating city.
The ability to contract with other guilds for an agreed upon sum and time to either protect or help plunder.
Real ship damage, holes that can be repaired, masts that can be chopped down, ships that can be rammed and split in half

Not sure if that's an entirely accurate statement. As I understand it, the stretch goals are implementations born from the designs of the developers, not the player community, that would have been in-game, at some point. But, with player backing, it's just happening sooner, rather than later.
Putting something that doesn't fit, or you as a developer don't want in a game, just seems counter-productive, and wouldn't make much sense, imo.
Wow, BDO is struggling with that aspect? That's kind of sad, tbh. AA had the naval stuff down since day 1, never had to worry about the net code there (any more than anywhere else that is).

I know the lead devs played AA , the ocean navel gameplay from AA was the best part about that game. I think AOC devs have designed the world from the ground up with Navel content in mind. Let's hope they can get up to par with what AA has.
Just a side note: Whirlpools destroy your ship, not slow it briefly.
Instead of safe areas so far from the coast I think there should be a fleet of buffed NPC coastguard. Racing to the coast to avoid pirates would still occur, but you wouldn't be 100% safe just reaching territorial waters. Your safety would be dependent on the coastguard spotting your ship in distress and in need of assistance. Harbors could be fortified with cannons, militia and such, so as you pull into range the safety of your vessel increases.
