Penalties for leaving a guild

1) Penalties for leaving a guild as a measure for circumventing game mechanics, such as:
Reason for leaving a clan:
1.1) To avoid a guild war
1.2) To identify a character as an ally or enemy, to attack or assist in PvP.
1.3) To carry packs, so enemies don't know you're from an enemy clan and don't attack. You can also deceive them and say they're a twink from an allied clan.
3) Penalty - leaving the clan, unable to rejoin for 40 days.
3.1) As well as a gold penalty, to discourage leaving and joining clans. 3.2) If the character has no gold, then:
3.2.1) The character is blocked from engaging in professions, gathering, processing, or crafting (they should ask guildmates to pay the fine).
3.2.2) The character is blocked from picking up loot (they should ask guildmates to pay the fine).
3.2.3) The character is blocked from gaining experience (they should ask guildmates to pay the fine).
3.2.4) The character's stats are reduced by 50%, or damage in PvP and PvE is completely disabled (they should ask guildmates to pay the fine).

But I can join another guild, an alt guild to the original guild with a penalty?
If I rejoin the original guild after day 40 do I get a penalty?
If I'm kicked from the guild can I rejoin it before 40 with the penalty?
If I get the penalty from rejoining can I leave the guild and have the penalty go away?
If I'm kicked from the guild but rejoin do I get the penalty?
I could go on and on, this opens a pretty big can of worms. I see the reason for limiting the leave and rejoin. I don't see this fixing the problem, There'll just be 4 or 5 disposable alt guilds to every guild that engages in this behavior.
Leaving a clan shouldn't be profitable,
otherwise it undermines the value of the clan system.
