So, like the title says where are our refunds or is a Class Action Law Suit incoming?
I've got refund on Steam and it worked for most people. But for those who bought packs get ready for long law suit if you want your money back.

If you bought on Steam, you might have some luck there. If you supported through other channels, then that's the neat part, you don't.
I got the founder bundle in 2020… $250 is what im looking to get back. I spent no money through steam.

Yep, 2x backer packages, $500 total. Where is this class action or refund at? This is ridiculous.

I have my doubts, but it needs to start somewhere and making records of this.
If the staff that were let go didn't get their final paychecks, or any money owed, why would you think you could get money back from a purchase you made, and why do you think you getting that money is more important than the ex-staff at Intrepid getting their final paycheck?

The only condition anyone had on any packages purchased were that kickstarter packs had the condition that the game will launch.
It launched on Steam, even if early access. There are no grounds for a class action lawsuit.

The joke is in the name of the game it literally is 'Ashes of Creation'
From one point of view, those that paid for the pre-order pack were promised things. Depending on the pack, x months of game subscription time, access to beta 1, access to beta 2, cosmetic items, in game currency (embers) etc. Since the game isn't going to make it to that point, this could be seen as a breach of contract since they aren't able to fulfill their obligation. People paid money to get these specific items, in which Intrepid is now unwilling/unable to give people these items.
Now, seeing the state of the company not having any funds… Well, thats a whole different issue. I think a discovery needs to be done to determine where these funds (kickstarter/web site purchases/loans) went. If it was determined that they were misspent (personal purchases, unusual salaries, etc), then those recipients should be held accountable. I'm sure the people that have outstanding loans are already in the process of pursuing this though. As for if there is enough remaining after the loans have been paid… I strongly doubt it.
I mean, technically you were subscribed for the lifetime of the game.

The highest level packages included specific details of an official launch party weekend in Las Vegas. If no such party occurred, a competent lawyer might argue it's evidence that Intrepid themselves don't consider the game as meeting the conditions of "launch".
Best case scenario then, you have 5 individual lawsuits, as that is how many people purchased the $10,000 package from Kickstarter.
Class action lawsuits typically start at around 30 or so people in the "class" that is bringing the lawsuit, so there is no class action lawsuit here. Even if there were enough people that had purchased that pack to warrant a class action lawsuit, only those that purchased a pack with that weekend would be able to join the class.
To further complicate matters, I am fairly sure that most of those packs went to friends of Stevens anyway.
